Can spouses settle financial issues during the case?

Yes. Muslim spouses can enter into a Khula settlement (wife-initiated divorce with financial terms) or a Mubarat settlement (mutual divorce agreement). Even during Faskh, parties may compromise and submit terms under Order XXIII CPC (compromise decree). Settlements usually involve:

  • mehr return or payment,
  • iddat maintenance,
  • custody,
  • property distribution.
