What if a spouse hides income during the case?

The Family Court may direct the husband (or wife in CrPC 125 proceedings) to produce:

  • Income Tax Returns,
  • salary slips,
  • bank statements,
  • property records.
    Under the Evidence Act, Section 165, judges have wide powers to ask questions. If income is hidden:
  • adverse inference is drawn,
  • maintenance is calculated on presumed capacity,
  • maintenance may be increased.
    Hiding income may also support Faskh for non-maintenance.
