How is a jointly owned house divided during the divorce process in India?

Joint property is first divided based on what both spouses agree to. If they cannot agree, the court decides by looking at how much each person contributed, financially or otherwise. The court may order the property to be sold and the money shared, transferred to one spouse, or kept in joint ownership. Indian law does not automatically give a 50–50 split; contribution and fairness matter.
