Yes, impotency is a valid reason to get a marriage annulled. Under the HMA, if the marriage has not been physically completed because one spouse is impotent, the other spouse can ask the court to declare the marriage invalid. If the court agrees, the marriage is treated as if it never legally existed, which is different from a divorce.
